I put $6,000 down in an escrow account with the insurance company on a home to purchase? Declined – No escrow?

Can anyone assist me with this issue I’m having as I’m a first time home buyer and I feel as if I’m being jerked around. I put 6k in an escrow account to buy a home. To make a long story short I could not meet the documentation required to proceed with the loan due to lack of time in business. I was at the mercy of BOA to send me the denial letter to start the process of getting my escrow money back. We’ll the letter finally after a week came in and was provided to the realtor Linda Trotter from Balasteri Realty in Broward County, Florida. She sent a document to me half filled out and when I accidentally put the date of the signature she instructed me to white the date out. I immediately asked her why should would send me a document incomplete. She tripped over her words and had nothing she could say other than lye! Now the seller Diana Evans 2613 S.W. 14th Drive scam, rip off property house home in Deerfield Beach, Florida along with her sharp tongued realtor Nicole west from Remax in Boca Raton, FL. is refusing to sign the letter necessary for me to get my 6k escrow deposit back. Can anyone point me in the right direction as to what steps I should take to be successful in getting my escrow deposit back. Thank you all in advice!

call your agents broker as almost every contract has an out for rejected financing. Were you no pre-approved for this purchase?

    I think you would be well advised to get a lawyer. Make sure you are paying them hourly, not a % of the money they recover. This sounds like a case where one well-written letter on law firm letterhead will get your money back in short order. There is no legal reason for them to keep it. This should cost you $200 for a letter, another $100 or two if a follow up call is needed. Seems expensive but it will save you hours of work and lots of worry.

    Presuming your contract was subject to financing and the denial letter arrived within the time specified in the contract, you’re entitled to a refund of your deposit. The escrow agent is bound by law not to release the funds until both parties have signed a release. If you feel the Realtors are causing the delay, start with filing a complaint with the brokers and the local Realtor association. Unfortunately, you may have to take the seller to court if they won’t sign. While you may feel the agents are to blame, I’ll bet it’s the seller.
